JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 19-02-2015 The petitioner seeks a direction to the Respondents to pay compensation to her as her father-in-law, who was a government servant, while posted in Civil Court, Danapur died, allegedly because of lack of proper medical treatment when he required it the most.
From perusal of dispute raised in the present writ application, it appears to me that it cannot be adjudicated in a proceeding under Article 226 of the Constitution of India. The petitioner will be well advised to pursue her remedy before the District and Sessions Judge, Patna. If she does so, the District and
Patna High Court CWJC No.6168 of 1998 (7) dt.19-02-2015 P2/2 Sessions Judge, Patna will listen to it and process her representation accordingly and if according to him, the petitioner is entitled to any compensation, he should pass necessary order this regard. Such decision must be taken within a period of three months from the date of receipt/production of a copy of this order. This application is disposed of with the observation as above.
