====================================================== CORAM: HONOURABLE MR. JUSTICE CHANDRA PRAKASH SINGH ORAL ORDER 02-04-2025 Heard learned counsel for the petitioner, learned counsel for the informant and learned APP for the State.

2. The petitioner has preferred this application for grant of regular bail in connection with Fatuha P.S. Case No. 191 of 2024 dated 27.03.2024 registered for the offences punishable under Sections 341, 323, 307, 302 read with Section 34 of the Indian Penal Code and Section 27 of the Arms Act.

3. As per the prosecution case, the petitioner and the co-accused persons are alleged to have assaulted the informant's brother with lathi, danda and iron rod. It is further alleged that the co-accused, Ranjeet Singh assaulted on the head of the informant's brother with an iron rod with intention to kill due to which he got injured and fell on the ground. No.2172 of 2025(2) dt.02-04-2025 2/3 accused persons assaulted him with sticks and bricks, when his son came to save his father he was also assaulted with an iron rod and lathi with intention to kill and they were also open firing. It is further alleged that the injured were taken to the hospital where the informant's brother was declared dead.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. It is further submitted that there is general and omnibus allegation against the petitioner and there is no specific allegation against the petitioner rather the specific allegation of assaulting the deceased is against the co-accused, Ranjeet Kumar. The charge-sheet has been submitted against the petitioner. The petitioner has no concern with the alleged occurrence. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 21.07.2024.

5. Learned A.P.P. for the State and learned counsel for the informant have opposed the bail petition of the petitioner and submitted that as per post-mortem report, the deceased had four external injuries which amply demonstrates that the deceased was assaulted by the accused persons.

6. Considering the aforesaid facts and circumstances

Patna High Court CR. MISC. No.2172 of 2025(2) dt.02-04-2025 3/3 of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Patna in connection with Fatuha P.S. Case No. 191 of 2024.

7. The application stands allowed.
