JUSTICE PURNENDU SINGH ORAL JUDGMENT Date : 11-07-2023 Heard Mr. Bindhyachal Singh, learned senior counsel along with Mr. Vipin Kumar Singh, learned counsel appearing on behalf of the petitioner; Mr. Ramadhar Singh, learned GP-25 for the State and Ms. Ritika Rani, learned counsel for the Accountant General.

2. Mr. Bindhyachal Singh, learned senior counsel appearing on behalf of the petitioner submits that in view of the fact that departmental proceeding is pending against the petitioner, petitioner is entitled for payment of 90% pension and

Patna High Court CWJC No.1712 of 2023 dt.11-07-2023 2/2 other retiral dues admissible in accordance with law and for redressal of his grievance, the petitioner wants to file representation before the concerned authority.

3. In view of the above, the petitioner, if so advised, may file a detailed representation for redressal of his grievance before the Additional Chief Secretary, Department of Health and Medical Education, Government of Bihar and the Additional Chief Secretary must dispose of the representation of the petitioner on the basis of law laid down by the Apex Court as well as the relevant circulars effective in the case of the petitioner within a period of six weeks from the date of filing of the representation and will ensure payment of all admissible dues including pension applicable in the case within aforesaid period along with the statutory interest till the date of payment.

4. The writ application stands disposed of.
