2. The present petition has been preferred for the following relief/s:

(i) for initiating a contempt of court proceeding against the opposite parties for willful and deliberate violation of the order dated 01.10.2020 passed in CWJC No.

16563 of 2011.

3. Although, number of show cause is/are there, the last show cause dated 03.04.2023 filed on behalf of the opposite party no.3 is worth taking note of and paragraph-3 read as follows:

3. that it is stated further that after exhausting necessary official formalities and on recommendation of the Bihar Public Service Commission made vide letter no. 3536 dated 13.12.2022, notional promotion has been granted to the petitioner to the post of Chief Engineer (Civil) in the pay scale of Rs.

5100-6300/- with effect from 01.12.1995, the date from which the person junior to the petitioner had been granted promotion to the said post. The order of promotion has been notified vide notification contained in memo no. 132 dated 16.01.2023 and a copy of the same has been communicated to all concerned for payment of consequential benefits to the petitioner.

4. The connecting Annexure is also on record and memo no. 132 dated 16.01.2023 issued by the Joint Secretary, Water Resources Department shows that they have passed an order in favour of the petitioner and in compliance of the High Court's order.

5. In that background, granting liberty to the family to agitate the matter, if they still have any grievance, the contempt petition is disposed of.
