ANJANA PRAKASH ORAL JUDGMENT Date: 28-01-2015 The petitioner has filed this revision application against the conviction passed by the Judicial Magistrate, 1st Class, Katihar in G.R Case No. 1082 of 1992 under Sections 411 and 414 of the Indian Penal Code and sentenced to R. I for one and half years which was affirmed by the Additional Sessions Judge 1, Katihar in Cr. Appeal No. 59 of 1995 dated 04.12.1999. The case of the prosecution is that the petitioner had been apprehended with the alleged stolen motorcycle of which he could not produce any valid papers.

On going through the revision application, I find that in paragraph 10, it has been stated that the petitioner has remained in custody for about eight months which in my opinion is sufficient sentence in the nature of the case. Hence, the revision application is dismissed with the modification in sentence to the period already undergone by him during trial.
