JUSTICE BIRENDRA KUMAR ORAL ORDER 20-02-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 324/341/342/325/447/307/302 and other minor sections of the Indian Penal Code. According to F.I.R. the petitioner and other named accused assaulted to the deceased with lathi etc. as a result whereof she died during the course of treatment. Submission of the petitioner is that there was free-fight between two parties and both sides have sustained injuries. Similarly situated co-accused Shobhit Das and others have been allowed bail by a coordinate Bench of this Court in Cr. Misc. Nos.46955 and 48094 of 2016.

P.S. Case No. 81 of 2016.
