The petitioner seeks bail in a case registered under sections 366(A), 120(B) of the Indian Penal Code. The father of the victim made allegation that the petitioner along with others kidnapped his daughter. Learned counsel for the petitioners submits that the victim appeared in the court and made her statement under section 164 Cr.P.C. and she has disclosed her age 17 years. She disclosed that Aklesh Kumar, Kamlesh Singh Mantu Singh and Ram Bichar Singh kidnapped her. Saurabh Kumar @ Chintu the petitioner was also sitting in the Bolero. She further disclosed that on request ,Saurabh Kumar @ Chintu dropped her to the Railway Station. She was not ill behaved. It is further stated that the doctor

It appears that the victim did not make any allegation of ill treatment against the petitioner. She simply stated that the petitioner was also sitting in the Bolero.

Considering the aforesaid facts and the nature of allegation made against the petitioner and the fact that the petitioner is in jail since 19.10.2014, the above named petitioner directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in Deo P.S. Case No. 70 of 2014.
