The petitioner is languishing in custody since 12.11.2014 in a case registered for the offences punishable under Sections 147, 148, 149, 341, 307, 353, 124A of the Indian Penal Code, 25(1-B)a, 26, 35 of the Arms Act, 3/4 of Explosive Substances Act and 17 of Criminal Law Amendment Act. The prosecution case is that the police received secret information that about 100 armed Maoists have gathered under the leadership of Sandeep Ji and Sheo Ji @ Baba for committing some serious offence the raid was laid when the Maoist fired at the police and subsequently three persons were apprehended, who disclosed the name of the petitioner. Patna High Court Cr.Misc. No.3803 of 2015 (02) dt.29-01-2015 2/2 petitioner and except the confession of co-accused nothing has been collected during investigation against the petitioner, there is no recovery from the petitioner and others have been granted bail vide Cr. Misc. No. 31452 of 2014.

Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge Ist, Aurangabad in connection with Sessions Trial No. 220 of 2014/42 of 2014 arising out of Salaiya P.S. Case No. 10 of 2014. Since the petitioner has serious criminal antecedent, the learned court below will positively cancel the bail bonds of the petitioner, if he substantially gets involved in some serious nature of the offence or defaults for two consecutive occasions.
