The petitioner being the husband of the informant is languishing in jail since 2.5.2016 in a case registered for the offence punishable under sections 498A, 494 of the Indian Penal Code and section 3/4 of the Dowry Prohibition Act. The accusation is of torture for non-fulfillment of dowry demands.

It is submitted by the learned counsel for the petitioner that the petitioner was forced to marry with the informant after abducting him.

It is submitted by the learned counsel for the informant that the marriage of the petitioner with the informant was performed of his own free will. No matrimonial suit was filed for annulment of marriage.

Patna High Court Cr.Misc.
