The petitioner seeks bail in a case registered for the offences punishable under Sections 363, 366A and 34 of the Indian Penal Code.
Learned counsel for the petitioner submits that the petitioner is in custody since 17.10.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. The informant alleges that on 15.08.2018 his minor daughter was kidnapped by the accused persons, including the petitioner, in a vehicle from the school gate. Learned counsel for the petitioner submits that the victim has returned and her statement was recorded under Section 164 of the Cr.P.C in which she has not named the

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.
Considering the fact that the petitioner is in custody since 17.10.2021, is a person with clean antecedent, chargesheet has been submitted in the case and the victim has not named him in her statement under Section 164 of the Cr.P.C., let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Kamtaul P.S.
