The petitioner has preferred this application for grant of regular bail in a case registered under sections 272, 273 and 34 of the Indian Penal Code and under section 30(a) of the Bihar Prohibition and Excise Act, 2016.

As per the prosecution case, 26 litres of country liquor was recovered from the shop of the petitioner. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from the possession of the petitioner or his shop. He has been falsely implicated in the case for oblique reasons. The petitioner is in custody since 20.11.2021 and has no criminal antecedent. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and

Patna High Court CR. MISC. No.1832 of 2022(2) dt.09-06-2022 2/2 taking into consideration the petitioner not having any criminal antecedent, his having remained in custody for 6 months and investigation in the case having concluded, the Court directs the petitioner to be enlarged on bail in connection with Sahebganj P.S. Case no.518 of 2021 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Muzaffarpur.
