JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-02-2020 Earlier the prayer for anticipatory bail of the petitioner was dismissed vide order dated 03.05.2019 passed in Cr. Misc. No. 17389 of 2019 on merit. However, again this anticipatory bail application has been filed on the ground that now the construction work has been completed. Heard learned A.P.P. also.

Having heard both sides, considering the fact that earlier the petitioner was enlarged on anticipatory bail till submission of charge-sheet and it was observed that if the construction was not found to be completed, the petitioner will surrender before the court below and make prayer for regular bail, as such, I am not inclined to reconsider the prayer of

Patna High Court CR. MISC. No.2573 of 2020(2) dt.26-02-2020 2/2 anticipatory bail of the petitioner.

This application is accordingly dismissed.
