JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 08-04-2019 Though the matter has been listed under the heading 'For Orders on Office Notes', with certain notes of the Registry, pointing out the defects in the writ application, ignoring such defects, this writ application is being disposed of after hearing the learned counsel for the petitioner and the learned counsel, representing the State-respondents at this stage itself. The petitioner has filed an application before the Circle Officer, Aurangabad, for demarcation of the land held by him. A demarcation case has accordingly been instituted as Demarcation Case No. 56/2017-18. It is the petitioner's grievance that, despite notices having been issued by the Circle

Patna High Court CWJC No.7043 of 2019(2) dt.08-04-2019 2/3 Officer, Aurangabad, the demarcation has not been done on the date fixed.

The petitioner appears to have approached the SubDivisional Public Grievance Redressal Officer, Aurangabad, for redressal of grievance relating to demarcation of his land. The Sub-Divisional Public Grievance Redressal Officer, Aurangabad, appears to have passed an order, asking the Circle Officer, Aurangabad, to ensure positively that the demarcation is done. It is the petitioner's case that, despite the order of the SubDivisional Public Grievance Redressal Officer dated 24.07.2018, the demarcation has not been done. The Court fails to comprehend a circumstance, in which, even the orders passed by the statutory authorities are not being implemented.

This application is, thus, disposed of with a direction to the Divisional Commissioner, Magadh Division, Gaya, to examine the circumstance, in which the order of the SubDivisional Public Grievance Redressal Officer, Aurangaband, has not been implemented. He will be obliged to identify the persons responsible for non-implementation of the said order, if any, and consider whether any disciplinary action is needed or not.
