The petitioner apprehends his arrest in connection with Forest Case No.05 of 2014, registered for the offences punishable under Sections 33(b)(c) and 63 of the Indian Forest Act.

The allegation against the petitioner is that the petitioner constructed his house on the forest land. Learned counsel for the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. The petitioner has got no criminal antecedent as stated in paragraph-3 of the bail application. It is further submitted that the petitioner has constructed his house on his

The learned APP for the State opposed the prayer for grant of anticipatory bail to the petitioner. Taking into consideration the facts aforesaid, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from today, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Gaya in connection with Forest Case No.05 of 2014, subject to the conditions laid down under Section 438(2) of the Code of Criminal Procedure.
