According to the prosecution case itself, one Munna Kumar Pandey was caught with looted motorcycle and the said Munna Kumar Pandey disclosed name of the petitioner and others and thereafter, petitioner was caught with one motorcycle which was, admittedly, not looted property of the present case.

Considering the aforesaid facts and circumstances as well as submissions of the parties and also keeping in mind that petitioner does not have any criminal antecedent, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan in Hussainganj P.S. Case no. 281/2014.
