The petitioner apprehends his arrest in connection with Bela P.S. Case No. 34 of 2020 registered under Sections 272, 273 of the Indian Penal Code and Sections 30(a), 36 of the Bihar Prohibition and Excise Act.

Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case. From bare perusal of first information report, it is evidence that the alleged seizure of IMFL was made from car and the driver of the so called car was apprehended on the spot. Further he submits that even from the first information report, it can be seen that there is nothing on

No.19756 of 2021(2) dt.10-01-2022 2/2 record to show that the owner of the said vehicle had any knowledge of the same, neither the apprehended driver of the so called vehicle disclosed anything or gave any statement with respect to the owner of the alleged seized IMFL. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Muzaffarpur in connection with Bela P.S. Case No. 34 of 2020, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
