The petitioner seeks bail in a case under Section 376 and other sections of the Indian Penal Code.
The victim made allegations that the petitioner forcibly put vermillion on her head and committed rape with her. She further alleged that the mother of the petitioner asked the mother of the informant to get her married but the informant was not ready.
Learned senior counsel for the petitioner submits that the doctor did not find any sign of rape on the victim. Marriage has already been performed. The petitioner is ready to keep the victim with him as his wife.
It appears that the victim disclosed her age to be 12 years. She made very specific allegations that the petitioner
Patna High Court Cr.Misc. No.4264 of 2015 (4) dt.30-03-2015 2/2 committed rape with her and also forcibly put vermillion on her head.
Considering the fact that the petitioner committed rape with a minor girl, aged about 12 years, I am not inclined to enlarge the petitioner on bail at this stage in G.R. Case No. 4014/14 (POCSO), arising out of Ishakchak P.S. Case No. 121 of 2014. Accordingly, the same is rejected.
The trial court is directed to expedite the trial and conclude the same within one year from the date of receipt o this order.
