JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 03-05-2023 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Rupauli P.S. Case No. 42 of 2022 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 337, 332, 427, 353, 436, 506, 120B of the Indian Penal Code and section 3 of Prevention of Damage of Public Property Act. As per the FIR, nine accused persons including the petitioner and 10 unknown persons obstructed the government work and some persons have sustained injury.
Learned counsel for the petitioner submitted that petitioner has falsely been implicated in this case. There is general and omnibus allegation against the petitioner. It is further submitted that petitioner has clean antecedent as stated
Patna High Court CR. MISC. No.2031 of 2023(2) dt.03-05-2023 2/2 in para-3 of this application. It is further submitted that similarly situated persons have been granted anticipatory bail in Cr. Misc. No. 4553 of 2020 vide order dated 06.12.2022. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the above named petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount to the satisfaction of the learned Chief Judicial Magistrate, Purena in Rupauli P.S. Case No. 42 of 2022, subject to condition as laid down under Section 438(2) of the Cr.P.C.
