The learned counsel for the respondentElectricity Board has appeared. The petitioner has filed this writ application praying for granting promotion to the post of Account Assistant with effect from 1981 by giving 10 % relaxation marks to the petitioner in the marks obtained by him in the departmental examination in 1980. The learned counsel for the respondentElectricity Board has placed the impugned order dated 14.03.2000 and has pointed out that in the said order it has been taken into notice that the petitioner appeared in the departmental examination

Patna High Court CWJC No.5427 of 2000 (3) dt.09-04-2015 in the year 1980 in which he did not succeed and thereafter he appeared in the subsequent examination held in the year 1984 wherein he was declared successful and in due course he was promoted to the next higher post of the cadre as Account Assistant. The learned counsel has also pointed out by placing the said order that the policy decision of the government to grant 10% relaxation marks to the scheduled castes and scheduled tribes employees in the departmental examination was adopted by the respondent-Electricity Board with effect from 25.06.1985 and as the petitioner has already succeeded in the departmental examination held in the year 1984 and was promoted there was no question of grant of the said benefit to him.

It has also further been noted in the said order that no such application by the petitioner was on record for grant of 10% relaxation marks in the examination held in the year 1984 and the only such application available in the records was of July 1986, and therefore, no such relief can be granted to the petitioner.

As no body has appeared on behalf of the petitioner to press this writ application, this writ application is dismissed as not pressed.
