The petitioner is languishing in custody since 23.11.2014 in a case registered for the offences punishable under Sections 376, 366, 394 and 420 of the Indian Penal Code. It is alleged that the informant's husband died due to some illness and thereafter the petitioner used to help financially during illness of the husband of the informant when some intimacy developed, consequently petitioner established physical relationship with the informant. Subsequently the informant gave birth to a child, but after the birth of the child the petitioner refused to marry.

It is submitted by learned counsel for the petitioner that after four months of the birth of the child the

Patna High Court Cr.Misc. No.4644 of 2015 (02) dt.05-02-2015 2/2 present case has been lodged on 30.08.2014 whereas the petitioner filed Complaint Case No. 2009C of 2014 against the informant on 25.08.2014 making accusation under Sections 420, 406, 504, 323 and 468 of the Indian Penal Code.

A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Bhojpur at Ara in connection with Sahar P.S. Case No. 132 of 2014.
