The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 302, 201, 34 of the Indian Penal Code.

As per the prosecution case, on 29.07.2022 all the accused persons including petitioners committed murder of the sister of informant by strangulation and disappeared the dead body.

It is submitted that thrust of accusation is against husband of the deceased. Petitioner no. 1 mother-in-law,

Patna High Court CR. MISC. No.10433 of 2023(2) dt.16-05-2023 2/2 petitioner no. 2 is sister-in-law and petitioner no. 3 is brother-inlaw of the deceased. Informant is not eye-witness of the occurrence and only on suspicion petitioners have been made accused in this case. Petitioners are separate in mess and property and they have got no concern with the family affairs of the deceased and her husband. There is general and omnibus allegation. As a matter of fact, the deceased committed suicide. Petitioners claim clean antecedents.

Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Bidupur P.S. Case No. 416 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
