Petitioner is languishing in custody since 10.11.2014 in a case registered for the offences punishable under Sections 419, 420, 467, 468, 34 of the Indian Penal Code.

It is alleged by the informant being the Circle Officer that he received a telephone call from a person claiming himself to be Commissioner for giving Rs.50,000/- to one of his persons, who is related to the Commissioner. Consequently, the petitioner deposited the money in the bank account and found that somebody has cheated him. It is submitted by the learned counsel for the petitioner that neither the telephone through which the call

Patna High Court Cr.Misc. No.4095 of 2015 (2) dt.30-01-2015 made nor the account number belongs to the petitioner and only on suspicion the petitioner has been made accused. The petitioner is accused in two other cases in which he was on bail and others have been granted bail.

Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SubDivisional Judicial Magistrate, Birpur, Supaul in connection with Nirmali P.S. Case No. 63 of 2013.
