JUSTICE SANJAY PRIYA ORAL ORDER 06-03-2019 This application has been filed for modification of the order dated 24.7.2018 passed in Cr. Misc. no. 32424 of 2018 , by which petitioner has been granted anticipatory bail in connection with Chhatauni P. S. case no. 91 of 2017 to the satisfaction of learned CJM, East Champaran, Motihari A supplementary affidavit has been filed today stating therein that petitioner is suffering from Cancer and cardiac problem. He also suffered fracture of his back bone. The petitioner is being treated by the doctors of Singapore which is mentioned in para 8 of the supplementary affidavit. The operation of his back bone has also been done on 5.3.2019. Learned counsel for petitioner submits that earlier he was granted 08 weeks time to surrender before the Court below
Patna High Court CR. MISC. No.3103 of 2019(2) dt.06-03-2019 2/2 vide order dated 10.10.2018 passed in Cr. Misc. no. 62864 of 2018. He could not surrender due to aforesaid reason. He, therefore seeks further time to surrender in the Court below. In view of such, order dated 24.7.2018 passed in Cr. Misc. no. 32424 of 2018 is further modified with direction to the petitioner to surrender in the Court below within a period of three months from the date of receipt of copy of this order and, in that event, the Court below will release the petitioner on bail as per terms and conditions mentioned in the order dated 24.7.2018 passed in Cr.
