====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 05-01-2022 The learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month.

Heard the learned counsel for the petitioner and learned APP for the State through video conferencing. The petitioner apprehends his arrest for the offences alleged under Sections 366-A of the Indian Penal Code, registered in connection withKhagaul P.S.Case No. 335 of 2019. The allegation against the petitioner is that he had kidnapped the minor daughter of the informant. The statement of the girl Bulbul Kumari has been recorded under Section 164 of the Cr. P.C. Her age has been assessed as 17.5 years, whereas the victim in her statement stated her age as 18 years. She has stated that she, without giving information to her family members, went to Siliguri along with the petitioner and solemnized her marriage. In paragraph no.3 of her statement

Patna High Court CR. MISC. No.12348 of 2021(2) dt.05-01-2022 2/2 she has stated that for one and half month she want to reside with her mother and after attaining majority she will live with her husband.

Considering the above facts and circumstances, let the petitioner above-named, in the event of his arrest or surrender within four weeks from the date of communication of this order, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-5th, Danapur, Patna in connection with Khagaul P.S.Case No. 335 of 2019 (G.R.No.4628 of 2019), subject to the conditions as laid down under Section 438(2) Cr. P.C.

Office shall ensure that all defects are removed by the petitioner within the stipulated time as provided hereinabove, failing which the matter shall be brought to the notice of this Court.
