The Petitioner seeks quashing of the order of nondischarge dated 25.7.2008 passed by the Judicial Magistrate, 1st Class, Vaishali at Hajipur, in connection with Desari P.S. Case No. 92 of 2006.

The submission of the Petitioner as per the petition is that since a Police Officer is not authorized to institute a case, the Prosecution should be set aside.

Since these are merely irregularities, I am not inclined to interfere in the matter.

The application stands dismissed.
