====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 11-10-2022 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners apprehend their arrest in a case

Patna High Court CR. MISC. No.2432 of 2022(3) dt.11-10-2022 2/3 registered for the offences punishable under Sections 341, 452, 379, 323, 307 and 34 of the Indian Penal Code. The informant alleges that on 10.10.2019 at about 5:30 P.M. the accused persons including the petitioner came and assaulted her with lathi, it is next alleged petitioner No. 1 snatched her gold chain and thereafter, petitioner nos. 6, 7, 10, 3, 4, 5 and Santosh Yadav along with 50 unknown variously armed attacked on her village. It is next alleged that the accused persons were abusing and were threatening to kill, it is next alleged petitioner No. 3 assaulted Jitendra Yadav with butt of the gun causing injury on his head when he was taken to the hospital.

Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and have been falsely implicated in the present case. It is next submitted that no reason for the occurrence has been assigned that the injuries suffered are simple in nature.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in

Patna High Court CR. MISC. No.2432 of 2022(3) dt.11-10-2022 3/3 the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Paraiya P.S. Case No. 170 of 2019 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Satyavrat Verma, J) gauravkr/- U T
