For the Petitioner :

Mr. Anand Kumar, Advocate For the State :

Mr. Kalyan Shankar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE SANDEEP KUMAR ORAL ORDER 14-07-2026 Heard learned counsel for the petitioner and learned APP for the State.

2.

This application has been filed for cancellation of bail granted to the opposite party no.2 by the learned Additional District & Sessions Judge, I, Navgachhiya, Bhagalpur, vide order dated 20.08.2025 passed in B.P. No.292 of 2025, in connection with Cyber P.S. Case No.38 of 2023 registered for the offence under sections 292, 376 and 354(B) of the Indian Penal Code and under section 66(E) of the I.T. Act. 3.

Learned counsel for the petitioner has prayed for cancellation of bail granted to the opposite party no.2 on the ground that the opposite party no.2 had admitted his guilt.

Patna High Court CR. MISC. No.12811 of 2026(2) dt.14-07-2026 2/2 4.

From the F.I.R., it appears that it is a case of consensual sex between the petitioner, who is a married woman and the opposite party no.2. From the impugned order, it also appears that in the Court below the petitioner had opposed the prayer of the opposite party no.2 for grant of bail. Further, the petitioner has not been able to show any good ground to interfere with the impugned order granting bail to the opposite party no.2.

5.

In view of the above, I do not find any illegality or infirmity in the impugned order. Accordingly, this application is rejected.
