Heard learned Counsel for the petitioner and learned APP for the State.

This application, for grant of anticipatory bail, arises out of Indrapuri PS case no. 30 of 2024, disclosing offences punishable under Section 109 and other allied sections of the B.N.S. Act.

The prosecution story, as per the First Information Report, is that on 09.10.2024 in the morning, while the informant was sitting at her door, petitioner along with other accused persons arrived there, started abusing and when protested, the petitioner assaulted the informant's son Vivek Kumar by lathi on his head, due to which, he sustained

Learned Counsel for the petitioner submits that both parties are next door neighbours. Learned counsel further submits that there is case and counter case, inasmuch as Indrapuri PS Case No. 31 of 2024 has been lodged by the side of the petitioner against the informant and others. Referring to the injury, learned counsel submits that the injuries caused to the informant's son are simple in nature. The petitioner is stated to be having clean antecedent.

Regard being had to the submissions made on behalf of the parties and taking into consideration the fact that both parties are neighbours, case and counter case is there and injuries caused to the victim are simple in nature, I am inclined to grant the privilege of anticipatory bail to the petitioner.

This application is, accordingly, allowed.

Let petitioner, abovenamed, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M. Dehri in connection with
