After some arguments, learned counsel for the petitioner seeks permission to withdraw this application to surrender before the learned Court below and seek regular bail. Permission is granted.

Accordingly, this application is dismissed as withdrawn with the liberty aforesaid.

However, if the petitioner surrenders before the learned Court below within four weeks from today and seek regular bail, the learned Court below is directed to consider the prayer of the petitioner on the same very day, especially considering the fact that a compromise has been entered into between the parties and one co-accused has been granted regular
