JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-02-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 25.11.2014 in a case registered for the offences punishable under Sections 420,406,379,504 and 411/34 of the Indian Penal Code. It is alleged that the informant's vehicle was hired by a school along with vehicle of the petitioner. Subsequently, the petitioner took the vehicle of the informant to the school but the engine of the vehicle was changed. Engine of the informant's vehicle was recovered from the possession of the petitioner. It is submitted by the learned counsel for the petitioner that without verifying that the recovered engine belongs to the informant, the accusation has been levelled.

Considering the nature of accusation, let the above named petitioner be released on bail on furnishing bail bond of Rs.

Patna High Court Cr.Misc. No.4635 of 2015 (2) dt.04-02-2015 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Bagaha, West Champaran in connection with Chautarwa P.S. Case No. 266 of 2014. Since the petitioner has criminal antecedent, the bail bonds of the petitioner will be accepted on filing of an affidavit by the petitioner before the learned court below that he will regularly cooperate with the investigation. The said affidavit will be transmitted by the learned court below to the concerned I.O. Non cooperation in investigation by the petitioner will give liberty to prosecution to file application for cancellation of bail by learned court below.
