The petitioner seeks bail in connection with Hajipur Sadar P.S. Case No. 602 of 2019, registered under Sections 467, 468 and 414/34 of the Indian Penal Code and 25(1-b)a, 26 and 35 of the Arms Act.

The accusation is that in course of patrolling duty three persons were seen coming in fast speed, but, on giving the signal to stop they started to flee away leaving the motorcycle, but, on chase, they were apprehended and disclosed their name Kunal Kumar Yadav, Deep Gwala and Akash Yadv (petitioner). On search, petitioner was found in possession of one loaded country made pistol and one mobile set, while Kunal Kumar

Patna High Court CR. MISC. No.2378 of 2020(2) dt.24-01-2020 2/2 was also found in possession one country made pistol whereas Deep Gwala was found in possession of one knife. Submission is that the petitioner was apprehended mere on suspicion and has been remanded in this case and is in custody since12.09.2019. Further, submission is that after apprehending by the police in this case, the police has also remanded the petitioner in Hajipur Industrial P.S. Case No. 153 of 2019, in which the petitioner was not named in the first information report.

Having regard to the facts and circumstances of the case, let the petitioner, above named be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Hajipur Sadar P.S. Case No. 602 of 2019 to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur, subject to the condition that out of two bailors, one must either be parent or close relative of the petitioner.
