2. The petitioners apprehend their arrest in a case registered for the offence under Sections 341, 323, 504, 506, 307, 379/34 of the Indian Penal Code.
3. The prosecution case, in brief, is that on 16.11.2023, while informant was in his home, these petitioners alongwith other co-accused, armed with lathi, danda & iron rod, entered in the house and started assaulting informant and other family members. Petitioner no. 2 (Gorelal Prajapat) is alleged to have assaulted on the head of Suraj Kumar with iron rod.
4. Learned counsel for the petitioners submits that
Patna High Court CR. MISC. No.1632 of 2025(2) dt.11-02-2025 2/2 injury, allegedly caused by petitioner no. 2, is simple in nature. There is no allegation of overt act against petitioner no. 1. Case and counter case. F.I.R. has been lodged after a delay of 45 days and there is no plausible explanation of delay. Petitioners claim clean antecedent.
5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioners, in the event of their arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Muffasil P.S. Case No. 1286 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
