The petitioner is languishing in custody since 28.4.2014 in a case registered for the offences punishable under Sections 302 and 307/34 of the Indian Penal Code.
It is alleged that this petitioner made indiscriminate firing causing injury to two sons of the informant, namely, Manoj Kumar and Mukesh Kumar. Subsequently, Mukesh succumbed to the injuries.
It is submitted by the learned senior counsel for the petitioner that the FIR was registered on 18.4.2014 but it reached the court of the learned C.J.M. on 20.4.2014 which suggests that either delay has been caused in registering of the FIR or some improvements have been made in the FIR.
Patna High Court Cr.Misc. No.4636 of 2015 (2) dt.04-02-2015 Considering the specific nature of accusation, this court is not inclined to grant bail to the petitioner in connection with S.T. No. 304 of 2014 arising out of Rajauli P.S. Case No. 70 of 2014.
This application is, accordingly, dismissed. However, let the trial be expedited.
