JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-04-2017 The petitioner is in custody since 10.08.2016 in connection with NCB Crime No. 06 of 2016, registered for offences punishable under Sections 20C and 299 of NDPS Act. Allegation against the petitioner is of recovery of 134.200 kilo grams of Ganja.
It has been submitted on behalf of the petitioner that nothing has been recovered from the possession of the petitioner rather the same was recovered from white Swift Dzire vehicle. Petitioner only happens to be the driver of the above stated vehicle and has nothing to do with the alleged recovery. The said vehicle belongs to co-accused, namely, Rajesh Kumar and on his
Patna High Court Cr.Misc. No.16921 of 2017 (4) dt.17-04-2017 2/2 instruction he was driving the vehicle and had no knowledge about the said act of co-accused.
Heard learned A.P.P. also.
Having heard both sides, in view of the fact that in this case, huge quantity of ganja has been recovered, as such, I am not inclined to grant the petitioner, the privilege of regular bail, it is accordingly rejected.
