The petitioner has prayed for regular bail in a case registered for the offence punishable under section 366A of the Indian Penal Code.

The prosecution case, in brief, is that the informant alleged that her daughter, aged about 14 years, has been kidnapped by the accused persons including the petitioner on the pretext of solemnization of marriage.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case due to dirty village politics. The victim girl was recovered and her statement has been

No.2030 of 2023(3) dt.21-04-2023 2/2 recorded under section 164 of Cr.P.C., annexed with Case diary, wherein, she did not support the prosecution version and stated that she went from her home out of her own sweet will. She further stated that she solemnized marriage with this petitioner in a temple of Delhi. It is also submitted that good sense has been prevailed between the parties and in support of this, Annexure-2 has been annexed with this petitioner. Moreover, petitioner is languishing in judicial custody since 25.10.2022. Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Kasim Bazar P.S. Case No. 42 of 2021 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate at Munger.
