The petitioner seeks bail in Malsalami P.S.
Case No. 160 of 2016 under Sections 10(a) 10(b)/11/12 of U.A.P Act, Sections 13/20/17 of C.L.A, Act and Sections 25(1-B)a/26/35 of the Arms Act.
The petitioner was arrested on the basis of confession made by co-accused Nirmal Kumar Sinha @ Bittu. From the possession of the petitioner one country made loaded pistol and 15 live cartridges, besides a mobile of Samsung company were recovered.
It is submitted by learned counsel for the petitioner that petitioner is in jail since 12.06.2016 and he has got no criminal antecedent. Co-accused Nirmal Kumar Sinha @ Bittu
Patna High Court Cr.Misc. No.14891 of 2017 (2) dt.19-04-2017 2/2 has already been granted bail vide order dated 15.03.2017 passed in Cr. Misc. No. 11777 of 2017. The petitioner is in jail for about 10 months and he has got no criminal antecedent. Considering the facts aforesaid and the nature of allegation made against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned 7th Additional District & Sessions Judge, Patna City in connection with Sessions Trial No. 835 of 2016, arising out of Malsalami P.S.
