This writ application has been filed against the Notification no. 1229 dated 04.11.2020 issued under the signature of respondent /Registrar of Patna University whereby and whereunder the salary of the petitioner has wrongly been revised in the pay-scale of Rs. 9300-34800/-, GP-4600/- w.e.f. 31.12.2015 though the petitioner is entitled for the said pay-scale from

Patna High Court CWJC No.627 of 2022 dt.24-10-2024 2/3 24.11.2004 and also the pay-scale of Rs. 5500-9000/- after grants of the benefits of 1st ACP in the pay scale of Rs. 5500-9000/- w.e.f. 09.08.1999. It has also been prayed for extending the consequential monetary benefits till the date of his superannuation and also consequential post-retiral benefits from July, 2018, since the petitioner has already superannuated from the said post w.e.f. 31.06.2018.

Learned counsel for the petitioner submits that during pendency of this case, the claim of the petitioner with regard to fixation of pay-scale has been scrutinized by the State Government, Education Department through Pay Verification Cell and fixed the pay-scale of the petitioner at level-9 of Rs. 53100167800/-. The copy of the same has also been annexed as Annexure P/7 to the rejoinder to the counter affidavit filed by petitioner on 26.06.2024.

In view of pay-fixation by the Pay Verification Cell of the State Government, the Patna University is directed to pay all consequential benefits as well as arrears to the petitioner according to pay-scale so fixed by the Pay Verification Cell within a period of six months from the date of receipt/production of copy of this order.

5. With the aforesaid direction, the writ application is allowed.
