KUMAR ORAL ORDER 28-02-2018 Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the Vigilance. The petitioner, who is in custody, seeks bail in connection with Special Case No. 75 of 2014 arising out of Karpi P.S. Case No. 122 of 2014 registered for the offence punishable under Sections 420, 406, 409/34 of the Indian Penal Code. Informant has alleged in his written complaint that President and Operator of N.G.O. Magadh Samaj Kalyan defalcated huge amount of government money meant for construction of toilets and without making any construction withdrew the amount, as such, misappropriated the government amount. Patna High Court Cr.Misc. No.6820 of 2018(3) dt.28-02-2018 2/2 is ward member of Panchayat and he has put his signature on voucher No. 12 of Rs. 61,880/- which was subsequently withdrawn by the N.G.O.

It has been contended on behalf of petitioner that all the toilets against which he has signed voucher was constructed. It has been further submitted that the similarly placed co-accused Arbind Kumar has already been granted bail by a Bench of this Court in Cr. Misc. No. 6776 by order dated 21.02.2018. It has further been submitted that petitioner has no criminal antecedents and he is in custody since 08.12.2017. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Vigilance-1st, Patna, in connection with Special Case No. 75 of 2014 arising out of Karpi P.S.
