JUSTICE VINOD KUMAR SINHA ORAL ORDER 09-01-2020 The petitioner seeks regular bail in connection with POCSO Case No. 43 of 2019 arising out of Main P.S. Case No. 20 of 2019, registered for offences punishable under Sections 341, 323, 379, 504, 506 and 354(A) of the Indian Penal Code and Sections 8/12 of Prevention of Children from Sexual Offences Act, 2012.

Allegation against the petitioner is of attempt to commit rape on the informant and when she raised alarm, her sister-in-law (bhabhi) came to save her, then petitioner snatched away ear ring and fled away.

It has been submitted on behalf of the petitioner that he is a student and has falsely been made accused in this case ad there is delay of three days in lodging F.I.R. Further submission is that he has been in custody since 18.11.2019 and he has to

Having heard both sides, in view of the above submission, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge -1st -cum-Special Judge (POCS) Act, Gaya, in connection with POCSO Case No. 43 of 2019 arising out of Main P.S. Case No. 20 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds with further subject to the condition that petitioner will not threaten the informant and her family members.
