JUSTICE DINESH KUMAR SINGH ORAL ORDER 02-03-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under sections 399,402 and 414/34 of the Indian Penal Code and section 25(1-B)a, 26 and 35 of the Arms Act.
On information that the miscreants are preparing to commit dacoity, raid was laid when four co accused persons were arrested from whom recovery of arms were made who disclosed the name of the petitioner and others who escaped from the scene. It is submitted by the learned counsel for the petitioner that there is no recovery from the possession of the petitioner and only on suspicion the petitioners have been roped in the present
Patna High Court Cr.Misc. No.4618 of 2015 (2) dt.02-03-2015 2/2 case.
This court is not inclined to interfere in the matter only because the petitioner has criminal antecedent. However, the aforesaid facts constitute grounds for consideration of the prayer for regular bail of the petitioner by the learned court below in case the petitioners surrender within six weeks from today in connection with Dehri (Dalmiyanagar) P.S. Case No. 407 of 2014 pending in the court of learned SDJM, Dehri, Rohtas.
This application is disposed of with the aforesaid observation/direction.
