The petitioner seeks bail in Laxmipur P.S. Case No. 48 of 2016, instituted for the offence under Section(s) 147, 148, 149, 302, 307 and Section 364 of the Indian Penal Code. It is alleged in the written report that on the date of occurrence, petitioner along with 7 other accused persons tied the son of the informant with rope in electric Pole and assaulted him with lathi, rod etc. on account of which, he died. Counsel for the petitioner submits that no specific allegation has been attributed against any of the accused persons of assaulting the son of the informant. He further submits that other co-accused persons alleged to have assaulted the son of the informant have already been granted bail by
Patna High Court CR. MISC. No.11943 of 2019(5) dt.31-07-2019 2/2 coordinate Benches of this Court vide orders dated 23.2.2017, 18.5.2017 and 26.9.2016 passed in Cr. Misc. 8047 of 2017, 23180 of 2017 and 27582 of 2016 respectively. Petitioner is in custody since 1.10.2018 having clean antecedent.
Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Shri Sumit Kumar Singh, learned Judicial Magistrate, 1st Class, Jamui, in connection with Laxmipur P.S. Case No. 48 of 2016, subject to the condition that both the bailors will be the close relatives of the petitioner.
