JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-06-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 273, 290 of the Indian Penal Code and Section 47 (A) (E) of Excise Act.

In huge quantity country made liquor and equipments which are used in preparing the country made liquor were recovered from the house of the petitioner. Submission on behalf of the petitioner is that petitioner is suffering from kidney disease since long and as a matter of fact, nothing was recovered from conscious possession of the petitioner. It is also pointed out that petitioner does not have any criminal antecedent.

No.25211 of 2016 (3) dt.22-06-2016 2/2 Regard being had to the facts and circumstances of the case as well as submissions of the parties, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Jadia P.S. Case No. 48 of 2016 pending in the court of Sri Kumar Krishandeo, Judicial Magistrate 1st Class, Supaul stands rejected.
