JUSTICE ASHUTOSH KUMAR ORAL ORDER 08-03-2022 Heard Mr. Rajani Kant Pandey, learned Advocate for the petitioner and Ms. Asha Devi for the State. The petitioner seeks bail in anticipation of his arrest in connection with Ramgarh P.S. Case No. 169 of 2020 dated 05.08.2020 instituted for the offences under Sections 8/20(b)(ii) (A)/21(a) of the N.D.P.S. Act.

It has been submitted on behalf of the petitioner that one Gaya Ram was arrested with 600 grams of Ganja and the petitioner is sought to be prosecuted in this case on the basis of confession of aforesaid Gaya Ram.

Except for the confession of the arrested accused person, there is no other material to connect the petitioner with the offence.

The petitioner earlier was made accused in a case of

Patna High Court CR. MISC. No.12590 of 2021(6) dt.08-03-2022 2/2 Section 307 IPC but, in that case, he has been granted bail. Regard being had to the aforestated facts, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sessions Judge cum Special Judge, Kaimur at Bhabua in connection with Ramgarh P.S. Case No. 169 of 2020, subject to the conditions as laid down under Section 438(2) Cr.P.C.
