JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 25-01-2019 The petitioner has moved this Court seeking a direction to the respondent authorities to return the money which he claims to have deposited towards allocation of Coal for various months. Learned counsel for the petitioner submits that the claim raised by the petitioner vide representation as contained in Annexure '7' to the writ application has not been decided by the District Magistrate, Vaishali. In the nature of the submissions, without going into the merit of the contentions this Court would dispose of the writ application with a direction to the District Magistrate, Vaishali to look into the claim of the petitioner, consider the same in accordance with the provisions of the contract or the scheme under which such money has been deposited by the petitioner, if

Patna High Court CWJC No.1346 of 2019(2) dt.25-01-2019 2/2 any, and in case it is found that the claim of the petitioner is genuine and is entitled for refund then the District Magistrate, Vaishali shall take an appropriate decision thereon within a period of 90 days from the date of production/receipt of a copy of this order. In case the claim of the petitioner is liable to be rejected, a reasoned order in this regard will be communicated to the petitioner within the given period.
