The petitioner is accused in connection with Koransarai P.S. Case No.54 of 2019 registered under Section 30(a) of the Bihar Excise Amendment Act, 2018. The accusation is that on receiving secret information about keeping the liquor in village-Nawadih at the boring of Mukesh Yadav who is running a liquor shop, police party reached at the boring of Mukesh Yadav and on seeing the police party some persons tried to flee away but one Ravi Ranjan was caught who disclosed the name of his associates Mukesh Yadav, Shashi Kant Yadav (Petitioner), Pappu Singh, Dayashankar Yadav, Anil Yadav and Vijay Yadav. On search of hut 432 bottles each containing 180 ml and 29 pouches each of 180 ml

Learned counsel for the petitioner submits that petitioner was not apprehended at the spot and his name has come in the confessional statement of co-accused, Ravi Ranjan. In fact the petitioner is accused in six other cases due to that reason the police implicated the petitioner. Petitioner is in custody since 22.11.2019.

Having regard to the facts and circumstances of the case, the, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge, IInd-cum-Special Judge, Excise, Buxar in connection with Koransarai P.S. Case No.54 of 2019.
