The petitioner, already in custody, seeks bail in connection with Case No. CI 592 of 2016 registered under Sections 30 (a), 37 (b) of the Bihar Excise Prevention Act, 2016. Allegation against the petitioner is that 13 litres of foreign liquor and 600 ml of country made liquor were recovered from his vehicle and he was also found in intoxicated state. Learned counsel for the petitioner submits that there is no recovery, search and seizure was not made properly in this case and the petitioner has clean antecedent and has been in custody in this case since 03.01.2017.

Having considered the aforesaid facts and

Patna High Court Cr.Misc. No.10125 of 2017 (3) dt.15-03-2017 2/2 circumstances, the petitioner, namely, Jitendra Yadav, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Purnea in connection with Case No. CI 592 of 2016.
