Petitioner apprehends arrest in Bhorey P.S. Case No.94 of 2019, registered under Sections 366(A) and 34 of the Indian Penal Code.

The mother of the victim disclosed that Rajan Ram (petitioner ) who was doing the work of electric wiring in her house enticed her daughter on 20.02.2019. When the informant went to enquire, the mother, sister and uncle of Rajan Ram disclosed that Rajan Ram had come with a girl but they drove him out from the house.

Learned counsel for the petitioner submits that there is no allegation of kidnapping against the petitioner. The victim in her statement under Section 164 Cr.P.C. altogether disclosed a different story and she denied the factum of her kidnapping. She disclosed that for the first time she left her house on 03.12.2018 and solemnized marriage with Rajan Ram in Thawe temple and now she is pregnant.

Considering the facts of the case, let the petitioner, above named, in the event of arrest/surrender before the Court below within a period of six weeks from the date of receipt of

Patna High Court CR. MISC. No.18 of 2020(2) dt.17-02-2020 2/2 the order, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gopalganj in connection with Bhorey P.S. Case No.94 of 2019 on the following conditions:-

(1) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the Court and shall remain physically present as directed by the Court and on his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the Court below.

(2) If the petitioner tampers with the evidence or the witnesses, in that case the prosecution will be at liberty to move for cancellation of bail.
