JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 22-06-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Bathnaha P.S. Case No. 372 of 2014, registered under Section 302, 120B/34 of the Indian Penal Code, pending in the Court of Chief Judicial Magistrate, Sitamarhi.

The present application has been filed for grant of provisional bail to the petitioner on the ground of treatment of his son, who is mentally unstable. The prayer of the petitioner has already been rejected on merit on 01.04.2016 vide Criminal Miscellaneous No. 9262 of 2016 taking into consideration and nature of allegation against the petitioner, who shot fire the son of the informant and one another.

Patna High Court Cr.Misc. No.23878 of 2016 (3) dt.22-06-2016 2/2 Having regard to the facts and the circumstances of the case and nature of allegation, I find no any reason to allow the prayer of the petitioner. Accordingly, prayer for provisional bail of the petitioner is rejected.
