JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-05-2020 Heard learned counsel for the petitioners as well as learned A.P.P. for the State through video conferencing. This relates to grant of bail in Raghopur P.S. Case No. 189 of 2019 registered for the offence under Sections 302, 201/34 of the Indian Penal Code.

In the F.I.R., it is alleged that widow sister of the informant has been killed by the petitioners to grab her property. It is further alleged that on 19-08-2019 at 12 hours, the informant got an information that door of the house of deceased is closed and as such, he started searching her, but did not find. Thereafter, on 20-08-2019, after getting information that one

Patna High Court CR. MISC. No.1650 of 2020(4) dt.28-05-2020 2/2 dead body in Gunny bag is lying in Chilouli Dhar, the informant went there and identified the dead body of his sister. It is submitted on behalf of petitioners that save and except suspicion, there is nothing against the petitioners. There is no eye-witness to the occurrence. Petitioner no. 1 is Devar of the deceased and petitioner no. 2 & 3 are nephew of the husband of the deceased. It is further submitted that in this case, chargesheet has already been submitted. Petitioners are in custody since 13-11-2019, having no criminal antecedent. Considering the aforesaid facts and circumstances, the bail application is allowed.

Let the above-named petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Birpur (Supaul) in connection with Raghopur P.S. Case No. 189 of 2019.
