JUSTICE DINESH KUMAR SINGH ORAL ORDER 06-02-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 364/34 of the Indian Penal Code.
The accusation is of kidnapping the minor son of the informant.
The victim in 164 Cr. P.C. statement, got his age recorded as 17 years where he stated that he was forcefully taken by Sujit Kumar, being the maternal brother of the informant, by Bolero car in which the petitioners were sitting and then he was forced to marry.
It is submitted by learned counsel for the petitioners that the victim boy filed Matrimonial Suit No. 105 of 2014 for
Patna High Court Cr.Misc. No.5094 of 2015 (2) dt.06-02-2015 2/2 declaring the marriage null and viold. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Jehanabad in connection with Paras Bigha P.S. Case No. 65 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
